OUR BUSINESS TERMS & CONDITIONS

Luna’s K9 Club Ltd (‘Luna’s K9 Club’, ‘the Club’, ‘us’, ‘we’ or ‘our’) takes pride in the service it provides to you and your pups (its ‘Clients’, ‘you’, ‘their’). These terms and conditions are in place to allow the Club to offer a safe and happy environment for all those who join the Luna K9 Club family.  

Please read these terms and conditions (‘T&C’) carefully as they govern the legal relationship between you and Luna’s K9 Club. These T&Cs may be updated from time to time by Luna’s K9 Club and any variation shall become effective from the date that they are posted on the Luna K9 Club website (www.lunak9club.co.uk).  

By enrolling your dog with or permitting your dog to attend Luna’s K9 Club, you are deemed to have accepted these Terms and Conditions. 

These terms and conditions form part of your membership agreement (together known as the ‘Contract’).

Luna’s K9 Club Ltd means Luna’s K9 Club, a company registered in England and Wales with company number 13090334 whose registered office is at 4 Quex Road, London, England, NW6 4PJ.

Bookings

  • A visit to the facility can be arranged, prior to all reservations, for all new clients.
  • After a successful visit to our facility, a trial day is required to ensure suitability of your dog to our day care.
  • Luna’s K9 Club will provide time intervals during which pick up and drop off services will occur. If an unforeseen circumstance arises, the time interval may be adjusted. Clients will be notified in this instance.
  • All bookings must be made at least 24 hours before the arrival date and only after a successful meet & greet or trial day has taken place.
  • Clients are required to provide anything that their dog’s require throughout the day, such as food, medication and a collar or harness.
  • Clients are required to provide a minimum of 48 hours’ notice to Luna’s K9 Club (in writing) if their dog(s) is not attending on the agreed/regular day(s).
  • If the Client does not send their dog for any reason and fails to provide a minimum of 48 hours’ notice to Luna’s K9 Club, for example due to holiday or sickness, the fee for the agreed regular day(s) is still payable in full.

Fees & Payment

  • The Client may swap their agreed regular days on an ad hoc basis subject to availability. It may be possible to add occasional extra days as required, subject to availability. Requests to do so should be made via email to lunak9club@gmail.com.
  • Full payment for services (agreed either at time of booking or subsequently) is to be made within 2 days of receipt of invoice or, by the date specified on the invoice if not already paid and always at least 24 hours before the start of the service date. 
  • On termination of the day care services or membership with Luna’s K9 Club, the Client shall immediately pay to Luna’s K9 Club any outstanding unpaid invoices, in respect of services supplied but for which no invoice has been submitted, Luna’s K9 Club shall submit an invoice, which shall be payable by the Client immediately on receipt.
  • For clients who are booking trial days for their dogs, we require payment in advance.
  • Where payment is not received in accordance with these terms and conditions of business, Luna’s K9 Club reserves the right not to proceed with any previously agreed arrangements and cancel any future day care services. 
  • Luna’s K9 Club is closed on Christmas Eve, Christmas Day, Boxing Day, New Year’s Eve and New Year’s Day.

Conduct and Interaction 

  • You confirm that you are the owner of the dog you bring to Luna’s K9 Club and that your dog lives with you either permanently or regularly. 
  • You consent to your dog playing and interacting with other dogs on Luna’s K9 Club’ premises. 
  • You consent to Luna’s K9 Club, in its reasonable opinion, matching your dog to a group based on personality trait, play style, age, size and temperament. You acknowledge that Luna’s K9 Club will make their decision based on what it reasonably believes are the attributes of the individual dog and the information you have provided.
  • All dogs who attend Luna’s K9 Club will take part in a varied daily programme that involves socialisation, enrichment, scent tunnels, ball pits, treats/chews and interactions and by sending your dog to Luna’s K9 Club, you consent to your dog taking part in these activities. In addition, appropriate adjustments will be made to allow the participation of dogs with special requirements.
  • You hereby confirm that your dog has no record of aggressive or anti-social behaviour and you have made a full disclosure of any characteristic or trait that might make your dog unsuitable for socialising with other dogs in the registration form.
  • At the reasonable discretion of Luna’s K9 Club, we reserve the right to terminate your booking and/or membership with immediate effect, should your dog be deemed as unsuitable for the Club environment, and may require you to collect your dog immediately. For example, should your dog show aggression, unacceptable behaviour or any other cause for concern that will not allow Luna’s K9 Club to provide the service without any threat to themselves, colleagues and other dogs in their care.
  • The client agrees to be responsible for all costs (including but not limited to medical care, claims, damages, legal fees etc) if the client’s dog should bite another animal or person.
  • The client agrees that on booking services for their dog they have fully disclosed any incidents or aggression, harm or threatening behaviour to any individual and/or any dog, and the client agrees to contact Luna’s K9 Club as soon as possible if any of these behavioural changes present themselves, or if the dog has the potential to cause any harm to any individual or dog.
  • Unneutered male dogs will be assessed on a regular basis, based on temperament, to ascertain their suitability to attend the Luna’s K9 Club premises. Likewise, unspayed female dogs will not be accepted whilst they are in season and Clients will be required to collect their dogs immediately should their dog go into season whilst attending day care.

Health, Medications and Welfare 

  • Luna’s K9 Club will act as guardian of your dog whilst it is in it’s care and may perform or take any action which they deem necessary in order to protect and keep your dog in good health. 
  • The Client is required to keep your dog registered with a veterinary practice that can provide emergency care. 
  • In the event of your dog requiring emergency treatment, such as in cases of accidents, illnesses, or injuries, you agree that the emergency vet designated by Luna’s K9 Club is authorised to treat your dog. The details of the emergency vet designated by Luna’s K9 Club can be provided to you. Luna’s K9 Club will use reasonable effort to contact the Client prior to authorising treatment, but in the event that we cannot reach you or your emergency contact, the Client authorises Luna’s K9 Club to make important healthcare decisions about your dog on your behalf.
  • Luna’s K9 Club will follow the Client and the veterinarians instructions to administer medications if required but cannot be held responsible for complications that arise as a result.
  • If any colleagues of Luna’s K9 Club are bitten or exposed to any disease/ailment received from the client’s dog (s) that has not been currently or properly vaccinated, the client will be responsible for all costs and damages that may be incurred as a result.
  • All dogs that attend Luna’s K9 Club are required to be fully vaccinated, treated for Kennel Cough and must be up to date with all parasite control, using a veterinary prescription product licensed for the treatment of lungworm, roundworm, heartworm, fleas and ticks given monthly, and tapeworm given at least every three months. Luna’s K9 Club holds the right to ask the client for proof of this. 
  • In any non-emergency circumstances in which your dog requires veterinary treatment, you will be contacted and treatment/appointments will take place at the dog’s regular registered vet or Luna’s K9 Club emergency vet, as agreed between Luna’s K9 Club and the Client.
  • We will make all practicable efforts to contact you, or your designated emergency point of contact, in all circumstances where euthanasia is recommended as a course of action by a veterinary professional. Should you and your designated emergency contact not be contactable, veterinary advice will be followed. Luna’s K9 Club will not be held responsible for the actions of a suitably qualified vet in these circumstances.
  • You give consent for the transfer of your contact details and your dog’s details, including medical history, between veterinary practices, when a referral is required. This includes the dog’s primary veterinary practice, Luna’s K9 Club emergency vet and any additional specialist referral centres as required.
  • For puppies who are starting their vaccination course, two weeks must have elapsed after your puppies last vaccination (in the vaccination course) /inoculation before your service can commence.
  • If your dog was born abroad, we will need to see their passport, and a record of any inoculations/vaccinations which would have been given to them before and after they entered the UK. We will also need to see a negative blood test result for Canine Brucellosis.     If your dog has not been tested for this, we advise you to seek support from your Vet. Until we see a negative result, then we cannot accept your dog in any of our services.
  • While Luna’s K9 Club takes all reasonable precautions, including requiring vaccinations, we cannot guarantee that your dog will not contract a contagious illness while in our care. The Client agrees that Luna’s K9 Club is not liable for any illness or condition unless directly caused by our proven negligence.

Collars, Harnesses & Leads

  • The Client agrees to send their dog to Luna’s K9 Club with a suitable, secure collar or harness with appropriate ID tag, during each visit to the Club. 
  • All dogs will be walked on leads unless they are in secured outdoor areas or securely inside the Luna’s K9 Club premises. The Client is required to consent to their dog(s) being off the lead, which can be provided upon registration or by formally informing one of our staff members who will record this on the dogs records. 
  • You give full consent for Luna’s K9 Club staff to walk your dog outside of our daycare facility, including (but not limited to) secure dog fields, local parks, or designated walking routes.
  • Walks may be individual or as part of a supervised group, depending on your dog’s temperament and socialisation needs.

Insurance and Liability 

  • Luna’s K9 Club is fully insured for the provision of dog day care services including valid public liability for the peace of mind of our Clients. A copy of our insurance is available on request.
  • All reasonable care is taken to ensure the integrity and suitability of the care provided.
  • The insurance only covers Luna’s K9 Club for the duration of the selected services and only for services arranged with Luna’s K9 Club.
  • You will take responsibility for any costs which may be incurred, either veterinary or other, as a result of any damage, accident or sickness caused to or by your dog and will pay any such costs or expenses on demand.
  • Nothing in these T&Cs shall limit or exclude Luna’s K9 Club liability for:
    – Death or injury to a human caused by its negligence, or the negligence of its employees, agents, or subcontractors.
    – Fraud or fraudulent misrepresentation; or
    – Any other liability which cannot be limited or excluded by applicable law
    subject to Clause 26, Luna’s K9 Club shall not be liable to you, whether in contract, tort (including negligence), for breach of statutory duty, or otherwise, arising under or in connection with the Contract for:
    • Loss of profits;
    • Loss of sales or business;
    • Loss of agreements or contracts;
    • Loss of anticipated savings;
    • Loss of damage to goodwill; and
    • Any indirect or consequential loss. 
  • Subject to Clause 26, Luna’s K9 Club’s total liability to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with your client agree, shall be limited to £1,000 or the total fees paid under the Contract, whichever is lower.
  • You agree that Luna’s K9 Club, including its directors, officers, employees, subcontractors, volunteers or other staff members are not liable for any behavioural or health problems, including injury, that might arise in your dog and you hereby release them from any liability of any kind arising from your dog’s attendance and participation at Luna’s K9 Club.
  • You understand that Luna’s K9 Club is an indoor facility and has secure doors and at least two barriers between any entrance and exit for maximum security, it is therefore extremely unlikely that any dog would be able to exit the facility unsupervised, however you hereby accept the potential risk of escape and agree not to hold Luna’s K9 Club or its directors, officers, employees, subcontractors, volunteers or other staff members liable for any loss or injury due to the escape of your dog from Luna’s K9 Club premises.
  • Luna’s K9 Club is not responsible for any damage caused by your dog in your own home whilst awaiting pick up services or after drop-off services have been completed. 
  • Luna’s K9 Club is not responsible for the acts of third parties present at your home prior to, during or immediately after our services have been completed as part of our dog transport services.
  • It is understood that the client will notify anyone with access to the home that the services of Luna’s K9 Club have been engaged.
  • The Client’s dog may be transported with other dogs in Luna’s K9 Club’s vehicle. The Client agrees that Luna’s K9 Club cannot be held liable for death or injury to their dog in the event of a motor vehicle accident.
  • The Client may provide Luna’s K9 Club with a key to their premises if they are not present during the pickup and drop off services. The client must complete the registration form before passing over the key. The Client’s keys will be kept in a secure safe, which is securely locked and only accessible by certain staff members of Luna’s K9 Club.

Entire Agreement and Waiver

  • These terms and conditions constitute the entire agreement between the parties and supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between them, whether written or oral, relating to its subject matter. 
  • Each party agrees that it shall have no remedies in respect of any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in this agreement. Each party agrees that it shall have no claim for innocent or negligent misrepresentation or negligent misstatement based on any statement in this agreement.
  • A waiver of any right or remedy is only effective if given in writing and shall not be deemed a waiver of any subsequent breach or default. A delay or failure to exercise, or the single or partial exercise of, any right or remedy shall not:
    1. waive that or any other right or remedy; or
    2. prevent or restrict the further exercise of that or any other right or remedy.
  • If any provision or part-provision of the Contract is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this clause shall not affect the validity and enforceability of the rest of the Contract.

Notices

  • Any notice or other communication given to a party under or in connection with the Client Contract shall be in writing, addressed to that party at its registered office or such other address as that party may have specified to the other party in writing in accordance with this clause, and shall be delivered personally, or sent by pre-paid first class post or other next working day delivery service, commercial courier, fax or email to the correctly addressed email address if sent delivered-read (so email delivery and receipt can be acknowledged).
  • A notice or other communication shall be deemed to have been received: if delivered personally, when left at the Client’s address provided by him/her; if sent by pre-paid first-class post or other next working day delivery service to the same address, at 9.00 am on the second business day after posting; if delivered by commercial courier, on the date and at the time that the courier’s delivery receipt is signed; or, if sent by email one business day after transmission
  • The provisions of this clause shall not apply to the service of any proceedings or other documents in any legal action.

Governing Law and Jurisdiction

  • The Contract, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation shall be governed by, and construed in accordance with the law of England and Wales.
  • Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with the Contract or its subject matter or formation.
